Agreement Policy

I/We agree to hold Performance Foodservice and Beacon Event & Incentive Management harmless of any and all claims arising from accidental death, injury or harm to persons and/or damage to, or loss of possessions, suffered by myself/ourselves, my/our family, my/our employees. I/we understand that by filling out and signing this form, I/we have accepted the trip with these conditions and that all applicable taxes on the trip are my/our sole responsibility regardless of whether I/we travel or not.

Travelers Liability Release and Advertising Consent

In order to participate in the Travel Incentive Program sponsored by Performance Foodservice and its Agent, Beacon Event & Incentive Management, receipt of which is hereby acknowledged, I, for myself, my heirs, executors and administrators hereby waive, release, discharge and agree to hold harmless Performance Foodservice and Beacon Event & Incentive Management and their respective officers, directors, employees, agents, successors and assigns, and anyone, authorized by any of them, from any and all losses, damages, costs, expenses, rights, claims, demands and actions which I, my heirs, executors or assigns may have arising from my participation in and/or my use of the trip in the Incentive promotion, including but not limited to personal injuries, death, disability, property damages, and attorneys' fees and expenses for litigation and settlement.

I also agree to indemnify and hold harmless Performance Foodservice and Beacon Event & Incentive Management and their respective officers, directors, employees, agents, successors and assigns or anyone authorized by any of them from any and all losses, damages, costs, expenses, rights, claims, demands and actions which any other party may have against me arising out of my participation in and/or my use of the trip in said promotion including but not limited to personal injuries, death, disability, property damages, attorneys' fees and expenses of litigation and settlement.

I hereby grant permission to Performance Foodservice, Beacon Event & Incentive Management and their respective officers, directors, employees, agents, successors and assigns or anyone authorized by any of them, to use my name, likeness, voice and biographical data, in whole or in part, in any and all media for the purposes of advertising, publicity and trade, and in connection therewith I hereby release them and each of them from all liability.

I hereby agree that Performance Foodservice and Beacon Event & Incentive Management have neither made nor are in any manner responsible or liable for any warranty, representation, or guarantee, expressed or implied, in fact or in law, relative to any prize, including but not limited to its quality, merchantability, fitness for particular purpose, or mechanical condition.

I/WE WARRANT THAT I/WE AM/ARE 21 YEARS OF AGE OR OLDER, AND THAT I/WE HAVE EVERY RIGHT TO CONTRACT IN MY/OUR OWN NAME.

I have read or have had read to me each and every word of the foregoing prior to its execution and am fully familiar with the contents thereof.*
